AN INITIATIVE MEASURE AMENDING THE CITY CHARTER This proposed measure would amend the City Charter to require the City of Santa Monica to provide annual funding to the Santa Monica Malibu Unified School District. The measure states that the required funding would replace any “non-departmental grant” from the City to the School District but would supplement, not replace, “targeted” grant appropriations and City-funded programs for children and youth. The initial amount of annual funding would be either $6 million or 4% of specified City general fund revenues, whichever was greater. The annual funding amount would increase by 1% of the specified general fund revenues if the annual growth in those revenues exceeded 3.5%. The City’s annual payment to the School District would never be required to exceed 8% of the City’s designated general fund revenues. The City would be allowed to decrease funding to the School District only if: (1) the School District notified the City that receipt of City funds would impair the District’s receipt of State funding; (2) six out of seven City Council members voted that the reduction was necessary because the City was in a local fiscal emergency; or (3) receipt of the funds would result in total School District funding exceeding an index figure reflecting the average funding of ten other school districts comparable in size to the School District’s and funded at the highest levels in the State. The School
District would be required to notify the City, annually, of how it planned
to spend the funds from the City and of how the funds were actually spent.
The District would not be required to spend the funds as planned and could
spend them for any lawful purpose. A remedies provision of the measure
would entitle any City resident to enforce the City’s obligations through a
